Pro Bono

It may not be proper if I do not write about good things happening here in the courts. The High Court of Madras (not Chennai mind you) and the Government of Tamil Nadu have established in every district "Legal Aid Centres'.

Eminent Lawyers (and also lawyers like me) have empanelled their services in these centres. Any person who is unable to afford the cost of litigation may approach the Legal Aid Centres and will be provided all services free of charge. The Lawyer will be paid for the expenses of the case and a nominal fee by the Legal Aid Board.

That apart, if a person is able to prove that he is not possessed of any money to pay court fee, that he is indigent, the law itself provides for filing a case 'informa pauperis'. The Court fee payable will be recovered later if and when the indigent person succeds the case and is awarded any money or property as a result.

That's really good. It will help the needy people definitely.

I am glad these things are happening in India. But is the system really working? Isn't money big these days. I heard ( pardon me if I am wrong) that the party with more money wins the case. Judges can be bribed.!

Its nice that such methods are adopted but are people going to use them effectively?? May be a centre would get just around 3 or 4 cases[??] as such per month. Majority of them donot want justice at all because they think that fighting a case is not affordable. The system is right....but there should be awareness about the system among the people, is there any?? If the people donot know about the system at all, then how they approach it? I think people need to be aware that justice is REACHABLE!

While its true that corruption is rampant; things are not all that depressing here. Merrit still has value. Not all cases are decided for extraneous consideration.

The system is quite a success the centers get lot more cases than 3 or 4 but the share of cases comming under the centre vis-a-vis private briefs are still very low; ofcourse awareness is necessary and the authorities are adopting various meathods to reach the message accross to the common man

As rightly asked about Archana, the need of the hour is awareness.

I keep hearing that Lawyers themselves and sometimes Policemen are involved often.

Also Why is that most of the lawyers seek political affiliation?
Of all the professions - doctors, engineers, CAs, why is that lawyers such a strong link with politicans?

Another question how far is it ethically correct for a lawyer to defend someone when its clearly known that such a person has committed such an act?

The law provides that the discussion between the lawyer and a client is privy to them(is that the right word?). Leave aside the Law,is it ethically correct?

Vasu please dont take it in a negative sense. I think these questions loom large to an average person.You are our legal representative adhaan ketten.

law should be accessible to all, that is not really happenning thanks to the high leagal fees, if this attempt becomes a success than it will make law accessible to all, a move in the right direction

i think it means
"for good " or something.

Pro means for
Bon means good.

maybe i got the etymology goofed up..

my favourite among latin phrases is "Vis major" meaning Act of God.

i like this becuase it is very easy to remember :-D

Thnks for stopping by. I should say there are still lawyers here who do a good job and charge less. There are also ones who CAN do well but are not exposed. High legal fees is sure a deterrant. But it is not worse than lack of awareness, which the legal aid centres try to tackle.

'Pro Bono' is the latin term for providing legal assistance without getting paid. Large firms have a seperate department called Pro Bono Department to undertake Free legal work.
